TERMS OF SERVICE

BackgammonGalaxy.com and the Backgammon Galaxy mobile application (collectively, the "Service") are owned and operated by Tadorne Ventures Limited, a private limited company registered under the laws of the Republic of Cyprus, with its registered office at Dimostheni Severi 12, 6th floor, office 601, 1080 Nicosia, Cyprus ("Company", "we", "us", or "our").

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU ARE NOT AUTHORIZED TO USE THE SERVICE.

IMPORTANT NOTICE FOR U.S. USERS: THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW THE "DISPUTE RESOLUTION" SECTION CAREFULLY.

1. The Service & Entertainment Only

Backgammon Galaxy is an online social gaming platform. The Service is for entertainment purposes only. It is not a gambling site. "Coins" used in the game are virtual items with no monetary value. You cannot cash out, exchange, or redeem Coins for real money, goods, or services at any time.

2. Virtual Currency ("Coins")

2.1 License, Not Property: Coins and other in-game items are licensed to you, not sold. You have a limited, personal, revocable, non-transferable, non-sublicensable license to use Coins solely within the Service.
2.2 No Value: Coins have no real-world cash value.
2.3 No Refunds: All purchases of Coins are final and non-refundable, except as required by applicable law or the policies of the third-party platform (e.g., Apple App Store, Google Play) through which you made the purchase.
2.4 Modification: We reserve the right to modify, regulate, control, remove, or eliminate Coins at our sole discretion, with or without notice. We have no liability to you or any third party in the event that we exercise these rights.

3. Star Membership & Subscriptions

3.1 Features: Star Membership grants access to premium features, which may include deeper analysis, cosmetics, or ad-free play.
3.2 Right to Modify Features: We reserve the right to change, add, remove, or modify the features, benefits, and technologies associated with any Membership tier at any time without prior notice. This includes, but is not limited to, changing the specific AI engine used for analysis (e.g., changing from one engine to another), adjusting analysis depth/speed, or modifying visual assets. Continued use of the subscription after such changes constitutes acceptance.
3.3 Billing:

  • Web: Subscriptions purchased via our website may be managed or canceled via your user profile or payment provider (e.g., PayPal/Stripe). Gold Coin purchases may be refunded at the Company’s discretion.

  • Mobile: Subscriptions purchased via iOS or Android are subject to the terms and management tools of Apple and Google, respectively. You must cancel through their platform settings. Gold Coin purchases may be refunded at the Company’s discretion.
    3.4 Cancellation: You may cancel your subscription at any time. Your benefits will continue until the end of the current billing cycle. There are no refunds for partial billing periods.

4. Game Analysis & AI

4.1 Technology: We use various third-party and proprietary software to analyze matches, conduct matches vs AI and calculate ratings (Galaxy Rating).
4.2 No Guarantee: While we strive for accuracy, we do not guarantee that the analysis is error-free, nor that it will match the results of other software.
4.3 Service Interruption: Analysis requires server connectivity. We are not liable for missing analysis data due to API failures, server outages, or maintenance.

5. Account Registration & Security

5.1 Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
5.2 Credentials: We use secure third-party authentication (e.g., Auth0, Apple, Google). You are responsible for maintaining the confidentiality of your login credentials.
5.3 Usernames: Once chosen, usernames cannot be changed. We reserve the right to reclaim or remove any username that violates our standards or infringes on trademark rights.

6. User Conduct & Fair Play

You agree not to:

  • Use external assistance (bots, AI software, or other humans) during gameplay ("Cheating").

    Engage in "chip dumping" or match-fixing to manipulate ratings or Coin balances.

  • Harass, abuse, or threaten other players in chat.

  • Upload content that is unlawful, obscene, or infringes on intellectual property.

  • Attempt to reverse engineer, hack, or disrupt the Service.

Violation of these rules may result in immediate account suspension, banning, and forfeiture of all Coins and Memberships without refund.

7. Intellectual Property

All content, design, graphics, code, and trademarks (including "Backgammon Galaxy") are the property of Tadorne Ventures Limited. You may not copy, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TADORNE VENTURES LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

10. Dispute Resolution (Binding Arbitration & Class Action Waiver)

For users in the United States:
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration conducted by the American Arbitration Association (AAA). YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

For users outside the United States:
These Terms shall be governed by the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the Service or email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
